Cumbria 2015 Flood - Council Tax Relief Scheme

How can I get the discount?

We have a list of properties which we know have been flooded. We shall automatically be applying the discount to these properties and therefore you do not need to do anything. If you have any enquiries, or feel your property has been missed, contact us on 0303 123 1702 or email revenues@allerdale.gov.uk . There is also a form at the bottom of this page.

Who is eligible?

*        The Flooding Incident that this scheme applies to is where domestic properties have been flooded between the 3rd and the 11th December 2015 in Cumbria.

*        The definition to be used for this scheme is from the National Flood Emergency Framework for England. Therefore the definition of flooded properties is :

Properties Flooded are those properties where it is considered that the property has been flooded internally. i.e. water has entered the property:

o   Basements and below ground level floors are included

o   Garages are included if in the fabric of the building. Garages adjacent or separate from the main building are not included

o   Includes occupied caravans and park homes but not tents

The relief will apply to both Unoccupied and Partly Occupied properties. In addition the scheme includes properties where you have become liable to Council Tax as a result of leaving your main residence as a result of flooding.

Unoccupied Properties

*        For properties that fit within this definition a 100% Council Tax Discount will apply to all properties that have been rendered uninhabitable[1] due to the flooding.

o   This relief will apply for a minimum period of 3 months, even you vacate the property for less than 3 months.

o   After 3 months the relief will cease upon re-occupation of the whole property.

o   If the property remains unoccupied and uninhabitable relief can continue until it is fully occupied (this has been extended in December 2016 from initially only being for 12 months).

Flooded/Partly Occupied Properties

*        For properties that fit within this definition a 100% Council Tax Discount will apply to all properties flooded or that have been rendered partly uninhabitable[1] due to the flooding and the residents have remained in the property . This includes where occupation of the whole property is limited by flood damage.

o   This relief will apply for a minimum period of 3 months.

o   After 3 months the relief will cease upon re-occupation of the whole property.

o   If the property remains partly unoccupied and uninhabitable relief can continue until it is fully occupied (this has been extended in December 2016 from initially only being for 12 months).

o   The relief will be subject to verification by Council Officers

Displaced Residents

Residents who have moved into temporary accommodation as a result of flooding may also receive relief in respect of their temporary home into which they have moved (provided they are liable for Council Tax at that address, and intend to return to the property which was flooded).

2nd Homes and Empty Properties

Properties which were empty or 2nd Homes at the time of the flooding may be allowed to claim this relief for up to a maximum of six months. Please complete this form to enable an assessment of entitlement to reliefs to be made.

 

YOU MUST NOTIFY US WHEN YOU MOVE BACK IN OR RE-OCCUPY THE WHOLE PROPERTY

The scheme was reviewed in December 2016 and it was agreed to extend the relief for all those still claiming it until their property is fully occupied.
