Licensing Act 2003 Guidance
Significant changes to the Licensing Laws in England and Wales
were introduced by the Licensing Act 2003. The
Act was fully implemented on 24th November 2005.
The effect of the Act is to modernise and integrate the various
licensing systems and provide a single scheme for licensing
premises which sell alcohol, provide forms of entertainment and
late night refreshment. This amalgamates the six
previous licensing regimes (alcohol, public entertainment, cinemas,
theatres, late night refreshment houses and night
cafes). The liquor licensing functions which
used to be administered by the Magistrates Court has transferred to
local authorities.
The Act is designed to meet the Government's four licensing
objectives:
- The prevention of Crime and Disorder;
- Public safety;
- The prevention of public nuisance; and
- The protection of children from harm
Anyone wishing to carry out a licensable activity i.e.
- Sell or supply alcohol; or
- Provide regulated entertainment or entertainment facilities;
or
- Provide hot food or drink between 11.00 p.m. and 5.00 a.m.
Will need a Premises Licence or Club Premises
Certificate. The sale or supply of alcohol
requires at least one personal licence holder.
