Council Funerals

Under the terms of the National Assistance Act 1948 S.50 (I) Allerdale Borough Council is obliged to dispose of the remains of persons found dead for whom no responsible agent can be found, primarily in order to prevent a health hazard.

Under the same Act the council may have cause to bury people for whom there is no other agent and where there are no resources - but is not obliged to do so, especially where the deceased is in the care of others (e.g. hospital, hostel, nursing home).

In all cases of local authority burial, the costs are borne by the Authority and are recoverable against any estate of the dead person - which can take up considerable manpower resources.

Requests for information on council funerals

The Council receives requests from individuals and organisations about those who have died with no known next of kin. Each request is dealt with individually

However, please be aware that we cannot guarantee that the information requested will be disclosed as any information related to a death may be exempt from disclosure under the following exemptions provided by the Freedom of Information Act:

  • Section 31 - Law enforcement and prevention of crime
  • Section 41 - Information provided in confidence
  • Section 40 - Personal information

Council funerals - updated February 2014

The Council carried out a public health funeral in April 2013 and January 2014. In both cases the next of kin were known. We feel that any further information is exempt from disclosure under the exemption provided by section 41 of the Freedom of Information Act, information provided in confidence. We believe for this particular public health funeral we have a duty of confidentiality towards the next of kin with regard to funeral arrangements. Disclosing details which would identify the deceased and therefore their family risks the council being in breach of this confidentiality. Therefore in this instance we feel the exemption on disclosure provided by Section 41 is engaged. As an absolute exemption we are not obliged to consider the public interest test. We also feel that the information is likely to be exempt from disclosure under Section 40 (2) and (3) of the FOIA.
