05/03/2010 - Second prosecution for breaching listed building law
A Wigton woman has been taken to court for a second time for failing to comply with listed building enforcement notice.
Ann Grindley, of Proctors Row, Wigton, was prosecuted by Allerdale Borough Council in January 2009 after she failed to comply with a Listed Building Enforcement Notice that she had been served with by Allerdale Borough Council in April 2007. The notice required the removal of two unauthorised skylight windows in the roof and the restoration of the listed property’s roof to its former condition. At that time Ms Grindley pleaded guilty to the offence at North Cumbria Magistrates Court in Carlisle. She was fined £120 and ordered to pay court costs of £75 and a £15 victim surcharge.
Following the prosecution Ms Grindley still did not comply with the Listed Building Enforcement Notice. Therefore on 8 January 2010, Allerdale Borough Council again prosecuted Ms Grindley. Ms Grindley pleaded guilty for a second time and North Cumbria Magistrates adjourned sentencing to give Ms Grindley time to undertake the works.
The works have subsequently not been undertaken and today, 5 March 2010, North Cumbria Magistrates fined Ms Grindley £1,000 and ordered her to pay costs of £150 and a £15 victim surcharge.
