Workington man prosecuted for failing to clean up his land

A Cumbrian man has been successfully prosecuted for failing to clear huge piles of waste at his property.

Robert Blair, of Barnes Road, Workington, was convicted at West Cumbria Magistrates’ Court of failing to comply with a Section 215 Untidy Site Notice – a legal order which is used when a local authority considers that the condition of land or buildings is having a harmful effect on the area.

Mr Blair was ordered to pay a fine of £300 together with a victim surcharge of £30 and a contribution towards the Council’s costs of £100 – a total of £430. He must pay within 28 days and a collection order has been made.

The Council planning team had been in contact with Mr Blair for many months before legal action was taken. There had been complaints about the vast amount of waste materials in the rear yard of his property, as well as to the side of the building. Those piles of waste included tyres, metal, concrete slabs and wood, along with glazing and piping materials, wheelbarrow and even a trailer chassis.

The Section 215 Untidy Site Notice was served by the Council in May 2016 but Mr Blair failed to comply with it, so the decision was taken to take the case to court.

Mr Blair attended the hearing and indicated that he intended to plead not guilty. However, he was not represented by a solicitor and, after listening to submissions to the magistrates from Allerdale Borough Council’s legal manager, and hearing from the Court’s legal advisor, Mr Blair eventually conceded that he was guilty. He has indicated an intention to appoint a contractor to tidy the site in accordance with the requirements of the notice as soon as possible.

Councillor Michael Heaslip, Allerdale Borough Council’s Executive member for locality services, said: “It is not acceptable for someone to create such a mess that it affects the lives of those living and working around them. Seeing mounds of waste pile up on a scale like this had a very negative impact in the area and I hope this prosecution sends out a message that we will take action.”
