Key Decisions and private Executive decisions

Under the provisions of The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 the Council is required to provide notice within statutory timescales of its intention to make Key Decisions. Notice of Key Decisions must be published at least 28 clear days (including weekends and bank holidays) before they are to be taken. These are detailed in our Forward Plan.

A Key Decision is an Executive decision, which is likely -  

a)     to result in the Council incurring expenditure which is, or the making of savings which are, significant having regard to the Council’s budget for the service or function to which the decision relates; or

b)     to be significant in terms of its effects on communities living or working in an area comprising two or more wards in the area of the Borough.

The Council Constitution defines ‘significant’ as being expenditure or savings in excess of £50,000 or significant (e.g. 60% larger than budget heading).

A Key Decision may be taken by either the Executive or by senior officers exercising delegated powers.

There is a further requirement to give 28 clear days notice of the intention to hold a meeting of Executive in private (either exclusively or in part). Matters to be considered in private are clearly marked on the Forward Plan, together with the reason each item is to be considered in private.

General Exception - Five Days Notice

If it is impracticable for the Council to give the required 28 days notice of its intention to make a Key Decision in the Forward Plan, the decision may still be made if the Chairman of the Overview and Scrutiny Committee has been given notice in writing, of the matter about which the decision is to be made. The Council must publish notice of this at least five clear days before the date the decision is to be taken setting out the reasons why it couldn't be included in the Forward Plan. Cases of Special Urgency

If it is impracticable for the Council to give the minimum five days notice of its intention to make a Key Decision, the decision may still be made if the Chairman of the Overview and Scrutiny Committee has given his/her agreement that the making of the decision is urgent and cannot reasonably be deferred. The Council must publish a notice of this agreement and give the reasons why it cannot reasonably be deferred. Notice of Private Meetings of Executive

The Council is required to give notice, at least 28 clear days before an Executive meeting, of its intention to hold the meeting or part of the meeting in private and the reasons for this. This information is clearly marked in the Forward Plan document.

During this period the public can make representations in writing against the intention if they feel a decision should be made in public. Representations, including reasoning, should be made to Democratic Services, Allerdale Borough Council, Allerdale House, Workington, Cumbria, CA14 3YJ or democratic.services@allerdale.gov.uk 

In addition, a further notice must be published five clear days before the meeting, restating the reasons for being held in private and details of any representations received about why the business should be transacted in public and the Council’s response to those representations. Special Urgency Provision for Private meetings

If it is impracticable for the 28 days to be met, the meeting can go ahead if the Chairman of the Overview and Scrutiny Committee has given agreement that the meeting is urgent and cannot reasonably be deferred. The Council must publish a notice as soon as reasonably practicable explaining the reasons.
