Unauthorised Building Work

Regularisation Certificates

Carrying out work without notifying the local authority is a contravention of the Regulations. In relevant circumstances the local authority may take action under section 36 as outlined in paragraph 2.13.  In the case of unauthorised work commenced on or after the 11th November 1985 the owner may apply to the local authority for a regularisation certificate.  A fee, which is not refundable, must be paid when the application is made.

Regulation 21 lists the information to be given in an application for a regularisation certificate.  This will include plans of the unauthorised work and plans showing any additional work needed to ensure compliance with the Regulations which where in force at the time the work was originally carried out.

On receipt of the application the local authority may require the owner to lay open the work or make tests and provide samples of materials in order that it can decide what work, if any, is needed to ensure compliance.

When satisfied that it has sufficient information the local authority will notify the owner of the work, if any, which  is needed to comply with the relevant requirements of the Regulations, taking into account the results of any application for a dispensation or relaxation that may have been made.  If this work is completed to its satisfaction the local authority can give a regularisation certificate to the owner.
