A Land Search. What is it?

The Council, by law, must keep a Land Charges register. The register records relevant information on every property within the borough. It includes information on highways status/ proposals, conservation areas, tree preservation orders, article 4 directions, enforcement notices, improvement grants and financial charges.

Searches of the register are carried out for a variety of reasons including when a house is put on the market and forms part of a Home Information Pack. The purpose of a search is to disclose to the interested parties any relevant entries on the register and any financial claims, planning permissions, building control applications and other council decision or restrictions that affect the property or parcel of land. Current fees and charges for land searches can be downloaded below. Official Local Land Charge Searches

The Local Land Charges search may be made up of 3 parts. They are the LLC1, CON29R & CON29O enquiries. These can be submitted individually or altogether depending on the information required.

  • LLC1 -  The Official Certificate of Search Form. This deals with all the registerable charges, for example financial charges, improvement grants, tree preservation orders, conditional planning consents etc.
  • CON29R -  This deals with the Planning and Building Control history of the property/piece of land, the status of the roads, notices issued by the Local Authority and also Radon Gas Assessments.
  • CON29O - Optional Enquiries.

CON29O optional enquiries can include any of the following questions:

  • Q.15 Simplified planning zones
  • Q.16 Land maintenance notices
  • Q.17 Mineral consultation areas

  • Q.20 Food safety notices
  • Q.21 Hedgerow notices
  • Q.22  Common Land, town and village greens

 These questions are charged for individually and only if requested.

What to expect from your Local Search

Incorporated within your Local Search are any matters on the Land Charges Register, Planning History, Building Control information from 2000 and a marked up plan in colour from the Highways Authority showing adopted and unadopted highways, Public Rights of Way and S38 Agreements within the vicinity of the property. 

Personal Searches

Any Individual can come into the Council Offices to collate the information from the different departments. A statutory fee of £11 is payable for the results of a search of the Land Charges Register.

(Please note any properties falling within the boundaries of the Lake District National Park must obtain the planning information from the LDNPA.)

Four days notice must be given and all bookings should be sent by email to landcharges@allerdale.gov.uk., Full address details of the property and plan should be submitted at least four days prior to your appointment to enable the Land Charges team to undertake the necessary admin work for the search results to be available on time for your appointment. From 11 August 2008 the planning information for search requests will also be available from the Land Charges Department.

How to request a Local Search

 

Online

Register and submit your search online for no extra charge using our land charges search request form. A plan marking the location of the property/land to be searched must be scanned in and your company will be invoiced on a monthly basis.

Post/DX

Complete relevant forms and submit with an ordinance survey plan clearly marking the location of the property/land to be searched with a cheque made payable to Allerdale Borough Council.

NLIS

Allerdale Borough Council is currently at NLIS level 3 meaning we can receive and return electronic searches through the NLIS hub.

Turnaround Time

Allerdale Land Charges aims to complete Local Searches within 5 working days (please note that this may be longer if additional questions are asked). We do not offer an expediting service but if a search is needed urgently give the office a call and we will be more than happy to help you.
