Advertising Consent

An Advertisement is defined as any WORD, LETTER,
MODEL, SIGN, PLACARD, BOARD, NOTICE, DEVICE or REPRESENTATION,
whether illuminated or not, in the nature of, and employed wholly
or partly for the purposes of advertisement, announcement or
direction (excluding any such thing employed wholly as a memorial
or as a railway signal), and includes any hoarding or similar
structure or any balloon used, or adapted for use, for the display
of advertisements.
In general the display of advertisements
requires consent. There are a number of exceptions to this
rule but they must fulfil detailed requirements. It is
suggested that you discuss your proposals with Planning before
preparing an application to ascertain if consent is or is not
required.
The Application for Consent to Display an
Advertisement form can be downloaded below, or can be completed
online via the Planning Portal 1App System (linked below).
1. Plans
Three copies of all plans are required. The
plans must include:
(i) Site/Location Plans
Although these would preferably be Ordnance
Survey extracts or a tracing thereof, they need not necessarily be
to scale. However, they should be of sufficient detail to
enable the Authority to locate the site/premises, on which the
advertisement is to be displayed, accurately.
(ii) Detailed drawings
These should show the size of the advertisement
and its position on the land in question. In the case of a
sign, these should also give the materials to be used, fixings,
colours, height above the ground and, where it would project from a
building, the amount of the projection.
2. Owners consent
It is a requirement of every consent granted by
or under the Regulations that BEFORE the advertisement to which the
consent relates is displayed, the permission of the owner of the
land or other person entitled to grant permission shall be
obtained.
3. Other consents
Consent given under the Advertisement Regulations (1992) is for
planning purposes only. Any other necessary statutory
consents, i.e. under the Petroleum Acts, must be obtained
separately.
