Private Land
Allerdale Borough Council will not go on to
private land to clear dumping, fly tipping or litter picking unless
requested by the owner and having a quotation for the clearance of
the area, agreed, in writing from the owner.
Dead animals will not be removed from private
land, provided that the animal is not in a prominent public
position or close to public footpaths.
Under Part III of the Environmental Protection
Act, the Councils are given powers to go on to private land to
clear litter, if they consider that the accumulations are
prejudicial to health or a nuisance. Any expenses reasonably
incurred may be recovered by them from the person whose act or
default the nuisance was caused, and if that person is the owner of
the premises, from any person which is for the time being
thereof.
