Smoking-related litterCigarette butts

Smoking-related litter covers items such as cigarette ends, match sticks and discarded cigarette packets. Help us tackle this problem by reporting it.

Why is smoking-related litter such a problem?

  • Cigarette litter makes up 82% of all litter found on our streets
  • Cigarettes are difficult to clean up. Butts fall into cracks in pavements, accumulate around grids, gutters etc.
  • Filters are composed of cellulose acetate, a form of plastic which can persist in the environment as long as any other plastic.
  • 28% of people don't think cigarette ends are litter - people think they are bio-degradable. But they are not
  • It is estimated that 122 tonnes of cigarette butts, matches and smoking related litter is dropped every single day, with a clean up cost of £342 million
  • After the introduction of the Health Act 2006 ('smoke free legislation'), England suffered a 43% rise in cigarette litter

What can we do about offenders?

The offence of leaving litter is covered by the Environmental Protection Act (EPA) 1990 Sections 87 and 88. This act has now been updated by the Clean Neighbourhoods and Environment Act (CNEA) 2005. The CNEA 2005 clarifys that the term 'litter', within the EPA 1990, includes litter relating to smoking. It is a criminal offence to drop litter of any sort and Allerdale Borough Council can prosecute people who drop this type of litter.

  • Local authority officers can issue fixed penalty notices for the offence of £75 which you are given 14 days to pay, reduced to £60 if paid within 10 days
  • Failure to pay the fixed penalty notice can result in the offence being taken to the Magistrates' Court with a maximum fine of £2,500 plus costs upon conviction
