Community Right to Bid

What is the Right to Bid?

The Community Right to Bid , which is also known as Assets of Community Value.  The right gives eligible community groups the opportunity to identify and nominate assets that are of value to the local community and nominate these for inclusion on a list of assets of community value maintained by the Council.

If an asset on the list comes up for sale, eligible community groups will have up to six months in which to make a bid to buy it.  However, these new provisions do not restrict in any way decisions by the owner of the asset such as who they can sell their property to, or at what price, and a community interest group does not have a right of first refusal to buy the asset.

A community could use this right to nominate a local asset like a village hall, a community centre, a playing field, a library or a children’s centre.  The right covers private as well as public assets.

The Council is required to keep a list of assets of community value in Allerdale and a list of unsuccessfully nominated assets.

  • Reasons for decision: The Panel concluded that although community use of parts of the nominated land had been evidenced, a large proportion of the area nominated is grazing land farmed by tenant farmers. The Panel therefore considered use for agriculture to be the main use of these areas. This use is not considered to further the social wellbeing or interests of the local community. The nominated land therefore does not meet the definition of an asset of community value in the Localism Act 2011.

The Wheatsheaf Inn, Abbeytown (ref: 2015/009)

Wakefield Road Car Park, Cockermouth (ref: 2015/011)

  • Reasons for decision: The Panel did not consider that the actual current use of the land nominated as a car park furthers the social wellbeing or social interests of the local community.   • Reasons for decision: The Panel considered that the use of the building as a church was a primary use.  The first test under the Localism Act 2011 section 88 is not met as the building has a primary use as a church and any community use of the property in this case is ancillary.
